Protection of Personal Information

The Société de l'assurance automobile du Québec assures you that all the personal information you provide throughout the compensation process remains confidential. The only persons who have access to such information are duly authorized staff members, in the performance of their duties.

The information requested is needed to establish eligibility for compensation and, where applicable, determine the amount of any benefits payable. This information is compulsory, and failure to provide it could result in the refusal to award compensation benefits or their suspension or termination.

This information may be used in implementing the Automobile Insurance Act or the Highway Safety Code, particularly in setting up an rehabilitation program for an accident victim and determining fitness to safely drive a vehicle.

The information may also be used for research, statistical studies or surveys within the SAAQ's mandates, but strictly in compliance with the Act respecting access to documents held by public bodies and the protection of personal information.

The SAAQ may gather and transmit information (notably, names, addresses, amounts of allowances and compensation) to the following departments or agencies under administrative agreements: Commission de la santé et de la sécurité du travail, the Ministère de l'Emploi et de la Solidarité sociale, the Régie de l'assurance maladie du Québec, the Régie des rentes du Québec, the Curateur public, the Ministère du Revenu, the Ministère des Relations avec les citoyens et de l'Immigration, and the Ministère de la Santé et des Services sociaux. It may also exchange medical information with health care facilities and professionals.

File access and correction
Under the Act respecting access to documents held by public bodies and the protection of personal information, you are entitled to:

  • respect for the confidentiality of your personal information;
  • have access to your personal information on file;
  • have the personal information it contains corrected, if incomplete, inaccurate, unclear or if the information gathered, disclosed or kept is not authorized by the Act.
