Speeding
The term speeding is used to describe the actions of a motorist who is driving a vehicle above the posted legal speed limit.
The term excessive speeding is used to describe the actions of a motorist who drives a vehicle well above the posted legal speed limit.
Speed limits are determined on the basis of the location in which vehicles are operating, under optimum road conditions (ideal weather, visibility and traffic flow, etc.).
That is why under section 330 of the Highway Safety Code, the driver of a road vehicle must reduce the speed of a vehicle when road conditions become difficult because of the following:
- darkness;
- fog;
- rain or other precipitation;
- slippery roadway;
- roadway not completely cleared.
When a motorist drives too fast for weather or road conditions (heavy traffic, poor road conditions, etc.), even if the speed is within the posted speed limit, this is deemed unsafe speeding.
