What are the Penalties?

Motorcycles, Mopeds and Motorized Scooters
Drivers or passengers of motorcycles, mopeds or motorized scooters who do not wear a compliant helmet or who do not allow a peace officer to examine their helmet are liable to the following penalties:

  • a $80 to $100 fine*;
  • three demerit points entered on their driving record.

If a passenger is under age 16, the fine and demerit points will be entered on the record of the operator of the motorcycle, moped or motorized scooter.

Power-Assisted Cycles and Off-Road Vehicles
A $100 to $200* fine applies if an individual:

  • does not wear a helmet that complies with manufacturing standards while operating or riding on a power-assisted cycle, off-road vehicle, or riding as a passenger in a sled or trailer. In this case, no demerit point is entered on the driving record with the SAAQ;
  • does not wear a helmet fitted with a visor or safety goggles while operating or riding an off-road vehicle, or who is a passenger riding in a sled or trailer towed by the vehicle.

Sale and Rental of Helmets
Businesses must sell or rent helmets that comply with the aforementioned manufacturing standards. Violation of this requirement is punishable by a $200 to $300 fine.*

* Other fees may be added to the fine provided under the Highway Safety Code (contribution to the IVAC crime victims compensation program, registry fees, etc.).
